The Nevskaya Concessional Company was obliged to seek legal redress from the St. Petersburg Administration for the abrogation of the concessional agreement regarding the construction of the Orlovsky tunnel. Smolny attempted to reverse the decision of the Arbitration Court, but unsuccessfully.

Evgeniy Druzhinin, Head of Maxima Legal’s Real Estate and Construction Department, considers that there is no guarantee that the decision of the Arbitration Court will be carried out in this case.

On 12 November the public prosecutor’s action to recognize the transaction to privatize the site of the Lesnoye Breeding Plant was fully satisfied by the St. Petersburg and Leningrad Region Arbitration Court. The breeding plant is owned by Zakhar Smushkin’s ‘Start Development’.

In the opinion of Evgeniy Druzhinin, Head of Maxima Legal’s Real Estate and Construction Department, the contract is likely to be totally abrogated, following which the territory may be re-privatized.

The Law ‘On the Participation of St. Petersburg in State-Private Partnerships’ has been in operation since the end of 2006. The new Federal Law ‘On State-Private Partnerships, Municipal-Private Partnerships...’ (224-Ф3) which is coming into force may complicate the implementation of agreements on state-private partnerships already signed by St. Petersburg (the Western High-Speed Diameter, Pulkovo, etc.).

Vladimir Kilinkarov, a Maxima Legal partner and Head of the Public-Private Partnership Department, gave his opinion on the possible legal consequences of the new law for state-private partnerships in St. Petersburg.
